Terms of Service

1. About the Service

Nova is a fitness platform offering:

• Marketplace: Connect athletes with personal trainers
• Tools: Training programs, logging, and progress tracking
• Nova Originals: Ready-made training programs
• Gamification: XP, levels, streaks, and achievements

The Service is provided by Gruvman PT & Coaching (org. no. 915 079 954), hereinafter "Nova", "we", "us", or "our". For trainers who process personal data about their clients, our Data Processing Agreement (novafitness.no/legal/dpa) also forms part of these terms.

2. Acceptance of Terms

By registering, downloading, or using the Nova app (the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations.

If you do not agree to these Terms, you must not use the Service.

3. User Accounts

3.1 Registration

• You must be at least 18 years old to use Nova. This applies to both customers and trainers.
• If we discover that an account belongs to someone under 18, it is blocked
• You must provide accurate and complete information
• You are responsible for keeping your login credentials confidential

3.2 Account Types

• Athlete (customer): Users seeking training and programs
• Trainer (coach): Professionals offering training services

3.3 Account Security

You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access at support@novafitness.no.

4. Trainers and the Marketplace

4.1 Trainer Status

Trainers registered on Nova operate as independent service providers, not employees or representatives of Nova. Nova is not a party to agreements between trainers and athletes.

4.2 Certification

• Trainers are encouraged to upload documentation of certifications
• Nova verifies submitted certificates to the best of our ability
• A "Verified" badge means documentation was reviewed, not that Nova guarantees the trainer's quality

4.3 Payment Between Trainer and Athlete

Nova takes 0% commission on agreements between trainers and athletes. Payment arrangements are made directly between parties.

4.4 Trainer Subscriptions

Trainers can subscribe to Nova for expanded features:

• Nova Basic: Up to 10 athletes
• Nova Pro: Up to 25 athletes + advanced tools
• Nova Elite: Unlimited + priority support

4.5 Data Processing Agreement (DPA)

As a trainer, you are the data controller for the personal data of your clients, and Nova is the data processor. The Data Processing Agreement (DPA) is a binding part of these Terms for trainers, and is considered entered into when you create or use a trainer account on Nova.

5. Acceptable Use

5.1 You Agree To:

• Use the Service only for lawful purposes
• Respect other users' rights and privacy
• Provide accurate information about yourself
• Follow trainer instructions responsibly

5.2 You Agree NOT To:

• Share inappropriate, offensive, or illegal content
• Harass, threaten, or harm other users
• Create fake profiles or impersonate others
• Attempt to hack, manipulate, or disrupt the Service
• Use automated systems (bots) without permission
• Circumvent security features or payment systems
• Use the Service to send spam or unwanted advertising

5.3 Consequences of Violations

Violations of these rules may result in:

• Warning
• Temporary suspension
• Permanent ban
• Reporting to relevant authorities for serious violations

6. Health and Safety

6.1 Before You Start

• Consult a doctor before starting a new training program
• Especially important for cardiovascular conditions, joint problems, pregnancy, or other health conditions
• Stop training and seek medical help for pain, dizziness, or discomfort

6.2 Personal Responsibility

You train at your own risk. Neither Nova nor trainers using the platform can be held liable for injuries occurring during training.

6.3 Not Medical Advice

Trainers on Nova provide fitness advice, not medical advice. For health concerns, always contact qualified healthcare professionals.

7. Intellectual Property

7.1 Nova's Property

The Nova app, design, logo, and all content provided by Nova are protected by copyright, trademark, and other intellectual property rights. You receive a limited, non-exclusive license to use the Service for personal use.

7.2 Your Content

You retain rights to content you upload (photos, messages, etc.). By uploading content, you grant Nova a non-exclusive license to store, display, and process the content to deliver the Service.

7.3 Trainer Content

Training programs and content created by trainers belong to the trainer. Nova has license to display the content to assigned athletes.

8. Nova Originals

Nova Originals are training programs produced by or for Nova.

• Purchased programs grant you personal use rights
• You may not resell, copy, or distribute the programs
• Access is tied to your account

9. Payment and Subscriptions

9.1 Pricing

All prices are displayed in Norwegian Kroner (NOK) including VAT where applicable. We reserve the right to change prices with 30 days notice.

9.2 Subscription Renewal

Subscriptions renew automatically unless canceled before renewal date. You can cancel anytime via Settings → Subscription.

9.3 Refunds

• Subscriptions: No refund for started periods
• Nova Originals: No right of withdrawal. Per the Norwegian Consumer Rights Act (angrerettloven) §22(m), the right of withdrawal does not apply to digital content delivered immediately when the consumer has given express prior consent and acknowledged that the right of withdrawal is forfeited. By purchasing Nova Originals, you consent to immediate delivery and acknowledge that the right of withdrawal is forfeited.

10. Limitation of Liability

This limitation does not apply to damages caused by gross negligence or intent, or rights you have under mandatory consumer protection laws (forbrukerlovgivning).

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by Norwegian law.

11.2 Complaints

If you are dissatisfied with the Service, contact us first at support@novafitness.no. We will attempt to resolve the matter amicably.

11.3 Consumer Disputes

If we cannot reach an agreement, you may bring the matter to the Norwegian Consumer Council (Forbrukerrådet) or Norwegian Consumer Authority (Forbrukertilsynet).

11.4 Jurisdiction

Disputes not resolved through complaint handling shall be decided by Norwegian courts with Salten and Lofoten District Court (Salten og Lofoten tingrett) as venue, unless mandatory jurisdiction rules give you the right to a different venue.

12. Changes to Terms

We may change these Terms from time to time. For material changes, we will notify you via email or in the app at least 30 days before the changes take effect.

Continued use of the Service after changes are notified constitutes acceptance of the new Terms.

13. Termination

13.1 Your Right to Terminate

You may delete your account at any time via Settings → Account → Delete Account.

13.2 Our Right to Terminate

We may suspend or terminate your access if you violate these Terms, or if we discontinue the Service. For termination by us without cause, we will refund prepaid amounts prorated.

14. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nova.
• Severability: If a provision is found invalid, the remainder of the Terms remain in effect.
• Assignment: You may not assign your rights under these Terms. Nova may assign to an affiliate or upon acquisition.
• No Waiver: Failure to enforce a right does not mean we waive it.
